At 6:30 p.m., immediately preceding Call to Order, the Village Board of Trustees will hold a public comment period for the purpose of allowing the non-elected general public the opportunity to address the Board on any subject of concern that is not the topic of a current or previous Public Hearing before the Village Board. Each person who wishes to address the Village Board of Trustees may do so at the podium for a maximum of 3 minutes. The Board will only receive comments during Public Comment. The Public Comment portion of the meeting is scheduled for a total of 15 minutes in length but will end sooner if the Village President has determined that there is no one else present who still wishes to speak. After Public Comment has ended, there will be a short recess to begin broadcast of the Board of Trustees Meeting.

6.   Plan Commission - Discussion and possible action on the following items:
 
a.   Resolution approving the Project Plan for and the creation of Tax Incremental District No. 12 of the Village of Menomonee Falls, Wisconsin Click to View
 
b.   Request of Tomich Investments III, LLC to adopt a Resolution approving the Final Plat of the Spencer's Pass West Subdivision proposed to be located on the north side of Silver Spring Drive, West of the Spencer's Pass East Subdivision, in the Southeast and Southwest 1/4's of Section 29.  At its meeting on April 8, 2014 the Plan Commission unanimously recommended the Final Plat be approved subject to 25 conditions. c.   Request of Fiduciary Real Estate Development to adopt an Ordinance amending the land use component of the Comprehensive Plan for lands located on the North side of Lisbon Road, approximately 800 feet East of Lannon Road, from the Park and Open Space Land Use Classification to the Low Density Residential Land Use Classification.  The subject land is located in the Southwest 1/4 of Section 32 and identified by Tax Key Number 127.999.  At its meeting on September 9, 2014 the Plan Commission unanimously recommended the Village Board adopt this Ordinance. d.   Request of United Financial Group to adopt an Ordinance amending the land use component of the Comprehensive Plan for lands located on the North side of Lisbon Road, approximately 2,000 feet East of Lannon Road, from the Low Density Residential Land Use Classification with the Density Bonus Overlay to the High Density Residential Land Use Classification.  The subject land is located in the Southwest 1/4 of Section 32 and identified by Tax Key Number 127.991.007.  At its meeting on September 9, 2014 the Plan Commission unanimously recommended the Village Board adopt this Ordinance. e.   Termination of storm sewer and sanitary sewer easements located on the East side of the parcels located at W161N9116 Hayes Avenue and N90W15944 Roosevelt Drive.  The subject parcels are located in the Southeast 1/4 of Section 3 and identified by Tax Key Numbers 12.202.003 and 12.984.  At its meeting on September 9, 2014 the Plan Commission recommended these easements be terminated. a.   Consent to Possible Purchase and Sale Agreement between the receiver appointed by the Court in  Village of Menomonee Falls v. Lodging Investors of Menomonee Falls, LLC, Waukesha County Case No. 2011-CV-003946 and one or more possible purchasers of the hotel that is the subject of the action.
  •  One or more presentations on possible purchase and sale agreement regarding the hotel  and the proposed debt refinancing for Tax Incremental District No. 6;
  • Consent of the Village, subject to court approval, of a possible Purchase and Sale agreement between the receiver appointed by the Court in  Village of Menomonee Falls v. Lodging Investors of Menomonee Falls, LLC, Waukesha County Case No. 2011-CV-003946 and one or more possible purchasers of the hotel that is the subject of the action.

Stats. §19.85(1)(e) to confer with the Village Manager, Village Attorney and Assistant Village Manager regarding the negotiation strategy to be adopted by the Village in negotiations with owner(s) of one or more properties in Tax Incremental District #6 over the terms of a possible purchase, development, redevelopment  and related agreement. 10.   Reconvene into Open Session Pursuant to Wisconsin Statutes 19.85(2) and Return to Village Board Room (Room #2245) for Possible Additional Discussion and/or Action Concerning any Matter Discussed in Closed Session and/or any Unfinished Item Remaining on the Agenda.
